Legal Question in Real Estate Law in New York

There putting a commercial building in my back yard

My nephew bought a house 2 months ago and now he just found out that a commercial building and parking lot will be going up practically in his back yard. He was told that the previous owners knew about this, but failed to mention it to him. This is very upsetting. What can he do about this?

Re: There putting a commercial building in my back yard

I will have to review the title work from his closing to see what the zoning requirements for the area are as well as the Contract of Sale. It is a tough case against the seller, unless he knew of the immediate plan for the commercial building, had received notices of the proposed site and withheld that information. I think you can try to build a case if those aspects exist.

Feel free to contact me should you wish to discuss this further.
