Legal Question in Real Estate Law in New York

Rent from my daughter's no-good former boyfriend

My daughter's creepy boyfriend moved into her apartment with her. We own the apartment. He paid us $700/month rent sporadically, and finally moved out when the relationship ended (there is a God...). He made 16 payments over 24 months. We never had a formal contract.

Can I sue him for the missed rental payments?

You can sue him but you won't get anything.

The Statute of Frauds requires that a lease for more than one year be in writing.
