Issuing a subpoena for a juvenile's phone records

Do I have the right to see the phone

bill of a juvenile who may have been

text messaging while driving a car that

caused an accident that killed my

husband?

You should have the right to get such records. If charges have been filed against the juvenile, the prosecutor should be able to get them too. May I ask what county you are in? Perhaps I could be of some assistance.

If a lawsuit were filed you could obtain the phone records during discovery and/or subpoena them. If a lawsuit has not been filed they would be more difficult to obtain, but you could possibly get a court order that would allow you to obtain the records.
