Theft by Conception, what is it?

I accepted a credit card machine, busines went bad, checking account closed, haven't made a payment on equipment. I offered to send it back (it's never been used) they refuse and are claiming they are filing suit for theft by conception.

How serious is this and what do you suggest I do?

First of all, it is called theft by "deception" It would be my suggestion to contact counsel so that hopefully you can arrange for a repossession. If this is a civil suit, the worst that can happen is that a judgment will be rendered against you. Theft by Deception may include fraud which would entitle the other party to punative damages adn attorney fees.
