My 14 year old son would like to come live with me, does he have any chance at a

I have been divorced for about 6 years and my x-wife has custody of my son and daughter. My son has asked to come live with me on a permanent basis. He doesn't get along with his mother all the time and makes bad decisions as a result. I don't know how to start the process of changing custody or whether he would have any chance of success with the courts. My son is 14 years old and generally a good soul. What can I do to initiate this process and will legal representation absolutely be needed. Also we live in different counties, so would this have to be done in the county he lives in?

The short answer is you should file a motion for change of custody in the same court where the divorce was finalized.

If everyone is in agreement it shouldn't be a big deal although the court will likely hold a hearing in any event (at least if they are still doing it the way they did 10 years or so ago).

You need to file a motion for the change of custody. It can be done in either the county the child lives or the county in which you got the divorce. She may even consent to the change in custody at which point a lawyer may be needed to prepare the paperwork and modify the child support as well as other misc. items.
