Legal Question in Family Law in Ohio

Prenuptial agreement--worth the $ ?

My fiance will not get married without a prenup. He says he wants to protect himself from having to give up 1/2 of the house and will not pay any alimony if we divorce. His name is on the house loan, but he does not own it. He has no other assets. Being in a community property state, would that not make a prenuptial agreement a total waste of his money?

First of all you are not in a community property state. Second, if his goal is to avoid alimony or sousal support, it is based on the length of the marriage and the relative earning power of the parties. A prenup will mean less and less the longer you are married. If he wants to make sure that he does not pay spousal support, just make sure that you keep working. I know that sounds sexist, but taking care of the kids is not a job that pays well.

Good luck!!!
