i have custody of my kids

my x and are divorce have be 4 3yrs he has had no contacted withmy3boys at all which they are happy.the x was abush to them he pays childsupport once ayr maybe.but not to get catched up.so my boys and i were in acar werck icalled up thex big mistake now he wants beable to see them and get hes payments up to date but he lives in another state.what can i do

Tell him no and if he doesn't like it let's see if he has the guts to ask the judge to order you to allow visits when he has flagrantly disregarded his visitation and support obligations!

Seriously, your primary obligation is to do what is in the best interests of the kids. Dad may have a right to visit with the kids and they also have a right to know their Dad. If there is a safe way for him to visit with them without extra expense to you and no risk of emotional or physical harm to them-you may want to try to work it out. At this point it is your call. It would be wise to talk directly to an attorney and let your decisions and responses be based on all of the facts. You do not want to be accused of violating a court order so you may need to go to the court for a modification of the existing order based on his behavior since the divorce.

It sounds like you are concerned that Dad is only interested now because he thinks that the kids are going to get some money because of the accident. If the kids do get money, the probate court will most likely put restrictions on how it can be used and who has control over it. If you have an attorney for the accident, he or she will be able to answer those questions for you. If you do not, you need to talk directly to an attorney as soon as possible.
