My daughter ripped her hand open at Buca Di Beppo

My daughter ripped her hand open at a restauraunt's bathroom stall door called Buca Di Beppo on 04-01-06. The claim handler is dragging their feet and want me to sign all kinds of medical history release forms for the hand injury. It has been almost 3 months and they just seem to drag me along. The medical bills total just about $1,000.00 and I didn't want to go for anything more. The more they string me along...the madder I become and now am considering sueing for compensation. How much is reasonable? She took 7 full weeks to heal and it kept re-opening because of the location on the hand. I am very frusterated at them at this point.Thank you

Each injury claim is different and the actual amount will vary based on its own circumstances. However, she would be entitled to more than just the medical bills. The claims handler is most likely hoping that you will submit your bills to your health insurance and the claim will go away!

Have you heard from anyone from the restaurant directly or just the insurance? What is reasonable?

1. All medical bills paid including mileage, parking, prescriptions, etc.!

2. something for the pain.

3. some money for inability to do the things that she normally enjoys doing (loss of enjoyment of life) Until the wound is fully healed.

4. Money for any scar or other disfigurement.

5. If there is a scar, money to pay for any revision of the scar that may be necessary in the future.

In addition, the parents are entitled to some amount of money for what is called a loss of services claim.

How much money for each of these categaories? That can vary widely depending on the age of your daughter, the location of the wound. The visibility of any scar etc.

Many times too often the insurance compnay drags their feet in hopes that it will just go away. Your daughter is definitely entitled to more than just the medical bills. I understand that you might not be a person who runs out and hires an attorney, as most people aren't. That is what the insurance company for the restaraunt is counting on.
