Legal Question in Personal Injury in Ohio

Homeowner's insurance

2 months ago I was at a neighbor's house with my dog and her dog was outside with no human supervision. Our dogs play together whenever possible so I let my dog off his leash so they could play.

Her dog was no leashed. Her dog came running around the side of the house and knocked me down on the driveway and I broke my leg. I have about $2,000 medical bills that my health insurance does not cover. Should her Homeowner's insurance cover that? Her agent does not seem to think so.

Re: Homeowner's insurance

There may be Medical Payments available under the homeowner's insurance policy. This provides payment for medical bills for a person who is injured on the property. Also, owners of dogs are strictly liable for damages caused by their dogs.

I cannot imagine a policy that would not cover that. Ask for a written expanation from that agent. If he or she is unwilling, you know you have an issue. Also, remember you have two years to sue for damages, so make sure you are completely fixed before you settle. I can always write a letter to that agent requesting their coverage, which would cause them to have put their answer in writing.

Re: Homeowner's insurance

If the owner of the dog has homeowners insurance, it should cover this loss. In fact, you are probably entitled to significantly more than just the medical expenses. It would be well worth your while (and would not cost you anything!) to talk personally with an attorney experienced in handling these types of claim. My office handles these claims on a contingency basis which means there is no cost to you. Attorney fees and costs are paid out of any money that we are able to get for you. I have been representing injured people for more than 30 years and will be happy to discuss this with you if you email your contact information or call me-No cost or obligation. Good Luck
