Legal Question in Personal Injury in Ohio

Can they really require this?

I was rear-ended in a car accident in 1996. Although bills were submitted on a monthly basis, other insurance refuses to pay and now wants an IME. Also, 3 years after the accident I went to a psychiatrist for depression about my divorce. Now the other insurance wants a release form so they can specifically look at my psychiatric records. Has nothing to do with the accident and I went 3 years after the accident! I don't want anyone to see those records but me and my doc, and I feel it's none of their business. Can they do this?

They can ask all they want but the records are subject to the doctor patient confidentiality. Therefore, you can refuse to release the records. It would then be up to the Judge to decide if you are required to reveal the information.
