Legal Question in Wills and Trusts in Ohio

My father passed away in December. He did not have a will. His home is paid for. My sister and I are the surviving children. I would like to move into the home; but I am not sure if it has to be sold to settle his estate. Is there a way to avoid selling the home and moving into the property?

In order to answer your question properly, I would need to know what the other assets and what the debts of the estate are. The house would only have to be sold if there were no other assets to pay off debts. Also how are the assets and are there any beneficiary designations on any of them? It would be helpful to you to talk to a probate attorney in your area so he can fully evaluate all the information and properly advise you.
