Legal Question in Credit and Debt Law in Pennsylvania

Can I sue ex-spouse to pay for half of debt incurred by both while married

While I was married to this person, we incurred some debts which are now past due and a judgments has been awarded against me. Can I sue ex-spouse to have her pay for half of that debt incurred, and have that responsibility removed from my credit?

It is difficult to answer your question without reviewing the divorce documentation. Usually when people get a divorce an understanding is reached regarding joint debts. Generally speaking each spouse is reponsible for joint debts. You are responsible for the full debt. Assuming no agreement to the contrary you may sue your former spouse for contribition. However, you can not avoid liability to the creditor. I suggest you have the matter reviewed by legal counsel. I would be happy to review your material for a minor fee and provide you with my opinion. I can be reached at 215-579-9390. My fee for review of your documentation and to give a formal opinion will be only $50. Gerald Hershenson Esq.
