Legal Question in Family Law in Pennsylvania

Divorce attorney filing motion to withdraw from my case

Although I have paid his bill in monthly increments, (though missed two months' payments...not consecutively...while sick) my attorney has filed a motion to withdraw from my case, and will not represent me at my upcoming divorce/settlement hearing. He informed me that I have a right to contest, in writing, but I don't know what to say, or even if it is worth the time (and there is not much of it) to contest it. I cannot hire another attorney, due to a disability which makes me unable to work for the time being, and my outstanding balance for this attorney. I've been married for 22 years, and separated for five years. My husband has legal representation. Will this put me at a disadvantage?

I suggest you answer the Petition to Withdraw. You must do so within the time specified. Draft a document with the heading and court term and number. Number each paragraph to correspond with the paragraphs in the Petition to Withdraw. Either admitted the particular allegation or deny it. Deny the right to withdraw on the basis you would be harmed. Has your attorney filed for alimony pendente lite? This could force you husband to pay alimony and attorney fees without consideration of any fault on your part. Good luck.
