Legal Question in Family Law in Pennsylvania

I have a son that is that is 21 months old. When he was born I signed his birth certificate but didnt realize that his mother gave him her last name. After i noticed it brought it up to her and she said that if i let her pick his god parents that she would change his last name to mine. She picked and never changed it. He lives with her and they live in Luzerne county in Pennsylvania. we have no custody arrangement or child support through the court. We have a joint checking acct that i put the money in every week and she spends it. So my question is do i have any way that i can have his last name changed to match mine? Does she have to agree to it?

You need to get a custody order and set up a support order as well. Without a custody order there is no way to enforce your custody rights.

If she doesn't agree to change the name you could ask for that in your custody petition.
