Legal Question in Civil Litigation in Pennsylvania

Appeal Small Claims Judgement

I was awarded a small claim judgement in PA. The defendant has now filed an appeal. The case itself is pretty much clear cut, contract signed one party did not keep their end of the contract. Lease agreement. What can I expect diffently if anything in common pleas court? It is in Delaware county Media PA.

Re: Appeal Small Claims Judgement

First be aware that within 20 days of the Notice of Appeal you have to file a complaint or the other party may win by default.

Second, whatever you filed with the DJ won't cut it in Common Pleas Court. There are all sorts of rules. Like you complaint has to be written in short number paragraphs. With each paragraph having one alleged fact. You also need to serve a Notice to Defend. Another rule requires that if you allege there was a contract a copy of the contract needs to be attached to the complaint as an exhibit. After you get all that done and filed you need to properly serve the complaint and there are several rules covering how to do that.

You have a bit of a project ahead of you.
