Hysterectomy gone bad

Hello I had a hysterectomy September 7th, 2006. It is now the 15th of December and I am still in pain. When I say pain-I mean painful urination, lower belly pain, my body is sensitive to touch, and I constantly feel feverish but I never get a temperature. The incision is still bleeding. When I go to the doctor he doesn't understand why I haven't healed properly or why I am in pain. I am constantly taking tylenol for pain and the feverish symptoms but I need to understand if I should be contacting a lawyer. Do you believe I have a case?

You need to find out what your medical problem is and whether it can be treated NOW, whether through this doctor or another doctor.

Considerations of a lawsuit are secondary, BUT any delay in resolving your medical problem, will also make it more difficult to pursue a lawsuit, as the Statute of Limitations may expire before it is clear whether you have a case.

In order for an attorney to take on a medical malpractice suit, he needs to understand what your permanent damages are, what caused them, and whether they could have been avoided with different medical care. Right now, we can�t answer any of these questions.

From the fact you�ve stated, I would not take on this case at this time. My opinion might change depending on what you learn about your condition. Another attorney may feel differently, so I encourage you to inquire.

In order to preserve your right to sue for malpractice, if that is appropriate, you need to resolve your medical problem as soon as possible.

I'd go along with the consensus of the other lawyers who responded, that the medical issues are more urgent. It certainly doesn't seem right that you haven't healed, and it's worrisome that your doctor can't explain it. So get a second medical opinion first.

You may. It is difficult to tell without speaking with you directly. WHen was the surgery? Where was it performed and by whom? Why was the surgery necessary? Please call me so that I can evaluate the case. I have a RN on staff that will assist in evaluating yoyur claim. Are you out of work as a result of this?

The first thing you need is a diagnosis. Once you know what is wrong, you will be in a position to seek out legal counsel if there was a mistake made during your surgery.

I urge you to get a medical diagnosis as soon as possible and then to seek out an attorney.
