Legal Question in Real Estate Law in Pennsylvania

Mechanic' s lien

..

Before the construction began my lender bank required the General contrcator to sign a waiver of lien in Bnak's standard form where in the contrcator waived his right and the right oif his subcontrcator and supplier not to put any lien. My agreement with the contrcator was that he would supply labour and tools and tackles. I will supply the material.Bank on the basis of my certificate paid the contrcator directly.

Though later the contrcator did few other contrcats on the house, after the contrcator's first contrcat was finsihed and paid for, I received a notice of lien from an equipment supplier's attorney. I sent them a copy of the recorded waiver of lien in pike county court yet the went ahead and put a lien. I never received any notice of judgement against me, but this lien is making it difficult for me to get home equity loan. The lien was placed in June 2006. The m/c in questuion was used in my job at the most 10% time. Actually it was used for another project. What should I do? Thanks

Re: Mechanic' s lien

You need to go to court to force removal of the lien and/or make the Main contractor pay the lien. I offer free initial consultations.
