Legal Question in Real Estate Law in Pennsylvania

Rental agency absolved of tenants actions?

Tenant of rented house near me attacks my planter in front of my home. Tears out plants and throws them in the street and kicks the planter 20 times. I have it on video. No damage. Just criminal mischief. I would like the rental company that owns the home and rents it to her to speak to her. They say since it isn't happening on their property not their problem. Since the rental company owns the property can they be held liable for their tenant harassing me?

Video of the action can be seen at www239.pair.com/nanden00/evidence/plantkiller.mpg

You asked about holding a landlord responsible for tenant's actions.

They are generally right. A neighbor can't hold the landlord of a property responsible for the action of a tenant until it upsets the "quiet enjoyment" of the neighbor. Quiet enjoyment is a fairly high standard and what you describe isn't even potentially able to involve the landlord.

What you describe is trespassing and destruction of property. You can bring this matter to the police for prosecution. Or you can even sue in small claims court for damages and an injunction.
