Legal Question in Sexual Harassment in Pennsylvania

sexual misconduct by my doctor?

I was recently at a dermatologist for the 1st time in 13 yrs for a skin check. He looked over my body including looking down my underwear - which a dermatologist has NEVER done to me before. When he was finished- before he left the room he began to tell me sexual jokes. The first one I ignored and pretended that I didn't understand b/c I was uncomfortable AND I was still naked and just covered up by my underwear and a paper robe. Then he stood next to me with his arm around me and told me another VERY LUDE AND CRUDE joke. I was very uncomfortable and VERY disgusted. What do I do?

Re: sexual misconduct by my doctor?

You asked about alleged sexual misconduct by a physician.

The conduct you describe does not sound like it crossed the line to illegal or otherwise actionable conduct. But it does sound inappropriate and possibly unethical.

You may want to follow up with a local attorney and see if a more full description of the conduct would raise an actionable case. More likely you should file a complaint with the medical licensing board and with the local police department. If the doctor is employed by a practice group or associated with a healthcare facility then you should also provide a complaint to the general counsel, compliance officer or chief executive officer of that facility.

As for the inspection inside of underwear. That may or may not be inappropriate. If the dermatologist was inspecting for lesions then it might be an appropriate examination. If the inspection was simply for prurient purposes then that may have been unlawful.

Telling sexual jokes could be considered sexual harassment or could simply be an incredibly inept attempt at humor.

And don't feel awkward for discussing this with other people. This doesn't sound proper and your experience may help others from falling for the same act.

Regards,

Roger
