as a non custodial parent can i take my child on vacation with me if the other parent wont let me take her with me

Unfortunately, you did not give enough information to answer this question fully.

If the other parentwon't allow you to have access to the child, then I guess you can't take the child.

If you want to take the child outside of the US, you are going to need the other parent's permission. If the other parent won't sign the necessary papers, then I guess you can't go on your trip.

It sounds like you might need to modify the current court orders.
