Legal Question in Real Estate Law in Texas

inheritence

My mother passed away 1 year and 4 months ago. Two weeks ago I was contacted by her previous employers retirement plan and insurance policy, that she never collected on. She listed no beneficiaries for this particular subject. My father also passed away the same year. Anyway I had to fill out a PROOF OF HEIRSHIP for this retirement co. Listing only the children of the deceased, which tthats what they wanted. My question is, on her will she list other people besides her children to recv part of the estate listed in that will. Does that also include this retirement as part of it even if its not in the will??? The will was probated and in the process of being closed.

Thanks You

Re: inheritence

Because the retirement account had no listed beneficiary, the retirement account funds go to the estate of the deceased. Because there was a will which has been probated, these funds will pass according to the will.
