My sister and I inherited several hundred acres of land many years ago. I want to sell her 1.15 acres of land. We had the land surveyed, but now her attorney is tellling her we have to have another 17.15 acres of land surveyed because we both own the first 17.15 acres. Can't we just have papers drawn up stipulating the 17.15 acres I am selling her, without having to pay for another survey of an additional 17.15 acres?

I would have to look at the legal descriptions of the property to see if the description is clearly ascertainable and not ambiguous. It is possible to look at the property as a whole and create a legal description that would be satisfactory. A title examiner at a local title company may be of help.
