Aunt dying no children or spouse

My aunt is very ill and the doctor doesn't give her long to live.. She is a widow and has no children. My brother and myself take care of her but there are other nieces and nephews. Who is entitled to her estate and how do we go about getting it?

I'm sorry to hear about your aunt. If she has a valid will, that will control her estate's distribution, subject to her debts. If she has no will, the laws of intestacy will apply and that will govern who gets what, subject to any debts of her estate.

If your aunt is still lucid, I would recommend her making a will. She may also wish to distribute some or all of her assets either personally, or via a durable power of attorney (again, she has to be lucid to do this).
