Legal Question in Family Law in Virginia

Divorce or separation for financial safety

I would like to know what I need to do, if anything, to dissolve my marriage so that I am not responsible for my husbands financial problems. I was married in Belize, Central America in 1980 by a JP from that country. I left my husband in Florida in 1999 to move to Virginia with my daughter who is now 22. I have never received any financial support from him since leaving for myself or my children. I have not taken any legal action at this point to end the marriage. I do not know where my husband is residing now, but I know that he is no longer where we lived at the time I left. I would like to find out if I can dissolve my marriage officially and eliminate any possibility of him using my name for credit references or anything else that might damage my credit. I received a call from a creditor recently looking for him. I know he no longer resides in the same place in Florida and I would

prefer not to have contact with him. Thank you.

Re: Divorce or separation for financial safety

Yes, as a properly domiciled resident of the Commonwealth, you can now file for divorce from your husband, even if you don't know his current address, and with the court's permission, you will be able to meet the notice requirements

by publishing a notice of your divorce action in a local newspaper for four weeks in a row.
