Legal Question in Real Estate Law in Virginia

Breaking my lease

Hi,

First I would like to thank i your for reading this.

On 7-23-07 i moved into my apartment. I moved in under the agreement that my ceiling fan would be fixed, carpet cleaned, bathroom cleaned and the washer and dryer removed because i was not supposed to have them.

About a month later i believe 8-24-07 management came in and removed the units without my knowledge, leaving a napkins stuck to the floor and a dead roach. i was told they did not have to tell me when they come in-I also inquired about belongings left in my apartment and found out that they belonged to the previous resident. this means my apartment was never cleaned. After arguing with my leasing office i finally got them to agree to clean my carpet and the laundry room-only my carpet was done-when i called the office they agent acted wierd and put me on hold for over twenty minutes-my call was never returned.

Now there was a shooting in my neighborhood on 9-22-07 i am desperate to get out!!!!! please help!! (757) 358-1327)

Re: Breaking my lease

Based upon the information which you've provided here in your question, I'd say that your move-out date without penalty would appear to be 7-23-08 or thereabouts, assuming that you provide the 30 days advance notice to your landlord or whatever your lease agreement requires.

In other words, none of which you've described here would likely be legally sufficient to sustain a claim of constructive eviction or a breach of your lease agreement sufficently material on the part of your landlord to allow you to terminate your current lease without penalty.
