Legal Question in Civil Rights Law in West Virginia

Hello i am Jamie Gaver. I got choked by a 29 year old man on december 29 , 2009 . I pressed charges on him. It is now the 19th of january 2010 and nothing has been done yet. The cop i spoke with took pictures of my neck and sent out a criminal complaint to the magerstrate. I just need to no what could be done if anything.
