Legal Question in Family Law in India
My query is regarding mine (Girl � 24yrs old) and my only brother�s right on mom�s ancestral property(Kerala). My uncle (mom�s elder brother) is playing behind the curtain to grab my mom�s family share and the issue is now almost on the edge of our parents divorce. Both of us are above 18 years old and our mom is physically challenged and cannot do her daily things without support. My uncle is taking care of the income from the rubber plantation on the property, we never asked about the details of the land or income and I�m not even aware the property is on my mom�s name or not. Frankly we (Dad, bro and me) are not much interested in the property but want to know at least I can hold my mom from transferring the land to my uncle�s name, which may avoid the divorce.

Make sure that its an ancestral property and if this is so, she can't give it to her brother. All the legal heirs will have equal share in that property.
