Legal Question in Family Law in Arizona

my son's father and I are not married and live in different states. Our son lives with me. How do I make sure that if I die, my parents get custody of my son?

You can designate your parents as guardians through a will. If the Father did not object, such would be sufficient. However, if he wanted to retain custody, your parents would have to file for guardianship at the time.

We can certainly help you consider and then pursue your options for trying to make this as strong a possibility as possible. Would the Father agree to such? If so, we could bind him to that agreement.
