Legal Question in Personal Injury in Arizona

claim denied

I was rearended in an accident and the insurance agreed to fix my vehicle and pay up to 1000.00 on any medical claims as well as pay out 300.00 for inconvenience. Now that I have gone to the doctor they are saying that I waited to long to go and that they will not pay the claim because the letter stated I needed to see a doctor within 45 days of the accident. What can I do to get them to pay my medical. All I want them to pay is what they agreed to pay-1000.00.

Of course we cannot comment on a letter or agreement from the insurance company without seeing the letter. Did you get this in writing?

You can always file a lawsuit for your injuries. If there is a large gap in time between the accident and the treatment, the defense will always argue that the treatment was perhaps caused by some other incident or condition, since people who are genuinely hurt in an accident typically seek treatment right away.

Also, $300 is a paltry sum for pain and suffering. Next time, see us right away for help and guidance.
