How is compensation for Pain and suffering after a car accident figured?

I was rearended on Jan 23'06 by a truck. I already have had Back surgery and my back started hurting as soon as the impact happened; I was transported to the Emergency room and treated and released with the diagonsis of Whipplash and low back pain. Now the insurance of the driver who rearended me is refusing to pay all the medical bills and also refuses to compensate me for pain and suffering.

What can I do to get them to pay my bills?

You are not doing yourself a favor by attempting to represent yourself in this matter. Insurance companies know that you will not be able to file a lawsuit, are not informed as to the value of cases, and sometimes insurance companies (usually) do not treat victims generously or with any benefit of the doubt. In fact, they tend to analyze the value of cases as if everything in the case will go 100% their way.

Get an attorney who is experienced and will handle your case personally, not turn it over to a junior attorney or legal assistant. It is important in a case like yours to have the guidance of an attorney immediately; you have already waited more than two months.
