Email..Gray area

At my work each employee has there own login/screen. My co-worker left his open one day with an open email with my name in the suject line, addressed to our main boss. The email questioned my character, how much time I spent with my daughter, and brought my work performance into question. Since then,(almost a year) everytime he leaves it open I print off the sent email and my bosses response. The response our boss gives is generally middle of the road, neither agrees or disagrees. But, never has he told my co-worker to stop the inappropriate emails. The viciousness of the emails has now reached an apex and I can't hold on any longer...What can I do legally?

What can you do legally? You can stop reading other people's private email.

Sometime when you and your boss are alone together, you might want to mention that you think this co-worker has gotten the wrong impression of you and see how the boss reacts. Given that he hasn't fired you based on what the other guy's been saying, chances are that he doesn't take those emails very seriously.

But be careful about letting your boss know you read these messages. He would be well within his rights to fire you for doing so. Given that some of the messages you've read are his, he might not be very forgiving.
