Legal Question in Disability Law in California
Employement Law, ADA
I was terminated after 21 years
with an excellent record eight
weeks after asking for and
receiving an accommodation in my
work start hours due to
surrendering my driver's license
because of my narcolepsy. IUOE
Local 39, my union is taking my
case to arbitration for lack of just
cause. If the union wins will I be
able to sue for damages separate
from the arbitration?

Re: Employement Law, ADA
Yes, I believe you can. In fact, I think you could sue REGARDLESS of the outcome at arbitration.
If we were to meet and go over your case, I would need to see the collective bargaining agreement. Also, i would need to see some documentation as to the pretext they used when they fired you. It seems odd that they accomodated you, and then fired you.
PLease give me a call at 877-LION-FOR-LAW to discuss this matter further.
