Legal Question in Civil Rights Law in California

The cops kept my cell phone after we got caught tagging. And well the cell phone contained pictires of my friends tagging. and they said that they had to keep my phone as evidence. Can the cops do that? Cant they just take the memory card with the pictures and give me my cell phone back?
