Legal Question in Consumer Law in California
debt payment
I lent someone $10,000 on the verbal agreement that I would be repaid in one month with interest. He gave me a check for the full amount, but asked me not to cash it yet. That was 3 months ago and he has only given me $250. The amount is too large for small claims court. What do I do? I've been very patient. I still have the uncashed check.

Re: debt payment
Try cashing the check at his bank. If there are insufficient funds, sue him in the Superior Court, limited jurisdiction (less than $20,000.00). You would probably be well advised to research the process, or obtain the services of an attorney in your area to assist you. You could also report this matter to the District Attorney for possible criminal prosecution.
