Legal Question in Criminal Law in California

felony reduction

I have been convicted of felony commercial burglary. I have since cleaned up my act and am scheduled on the 4th to have a motion 17b filed with another case which is being dismissed completely having the felony reduced to a misdemeanor. How long after this is done will I be able to pass a felony background search?

The problem is, just as there is no standard definition of the term "background search" or "background check," there is little regulation of the companies that advertise these services. Your felony conviction, even if it is "expunged," could be bouncing around these data bases for Goodness knows how long; and you will probably never find out if your prospective employer hires an outfit that erroneously / illegally outs you as a former felon.

Re: felony reduction

Never, if what you mean is the conviction 'disappearing' from your record. Your record will always show the conviction[s] as well as the subsequent changes to the record. The value of what you're doing is that you'll get to say 'no' to conviction on most private employment applications.
