Legal Question in Criminal Law in California

My wife has been accused to using too much make up sample from test sample from department store. They demand us to pay back the sample. And we did. Please advice us how we defend us in the court.

If she's being accused of a criminal offense, she needs to be represented by a good, local criminal defense attorney. I cannot imagine that she is being charged with a crime over using sample make up.

If the store is making a civil demand of some sort - you can agree to pay them for the product or they will have to make a choice - let it go or sue in small claims. Odds are they will let it go, but... you never know.

It's probably worth sitting down for a consultation with a local criminal defense attorney to discuss this more fully and get a better analysis of the whole situation. That attorney can review any documents you have and discuss the facts in more detail.

"Using" would mean putting on too much, not a crime, only a fashion offense. Taking would mean stealing, for which she could be charged with a crime, or sued for damages. Either way she could be fired as an 'at will' employee. Follow Mr. Dane's advice. If she hasn't yet been arrested, but thinks she will be, her attorney MAY be able to negotiate an actual �civil compromise agreement� with the store that will avoid her being prosecuted.
