Legal Question in DUI Law in California

I recieved a dui in california in Dec. 2010. This is my 2nd dui in Cal within 10 years. I also had a dui in Georgia in 09 that was filed as a first offense. Georgia is a NON COMPACT member. If Calif finds it can they charge me with a 3rd dui even though both are technically first offenses?

Yes. A DUI anywhere in US will be used by CA as a prior, WHEN they find it by record search - which they can find, compact member or not. You potentially face charges as a 3rd, counting the GA one .
