Legal Question in DUI Law in California
can a x prolee ever be in possession or own a look alike pellet pistol ,or rifle
1 Answer from Attorneys
Felons are barred from possessing firearms or ammunition. Period. Technically, pellet and airsoft guns don't count, BUT you would be wise to not tempt fate, or the police, by being in possession of what looks like a firearm. You might not be convicted of 'felon in possession', but you might be arrested 'mistakenly' and have to sort it out in court. You might also be charged with brandishing. Police and DA would have an incentive to be creative if they find you in possession. You also should consider the ordinances about look alikes; in some jurisdictions they are classed and treated as firearms if used 'like' a firearm. You might get to argue the point in court and on appeal.
