Legal Question in Elder Law in California

My mom is about 80 and can still get around but needs much assitance with a walker, w/stairs, and meals,etc. we have told her that she needs a caretaker to stay with her incase she falls again, to carry things for her, assist w/meal etc.

my mom has said she does not want to move from her home, and she does not want a stranger living with her. I live there but am not there much, her sister stay there but also does not stay there full time anymore.

what should we do?

would a social worker force her to stay at a living assitance place?

what if she falls again?

is there anything illegal about letting her stay at her home?

by keeping her at home there wouldn't be any so called elderabuse, or elderabuse leaving her with or without a parttime or full time caretaker?

what would you do?

If she can not take care of herself, and none of the family or frieds will do so in her home or theirs, your recourse is to put her in assisted living. If necessary you could apply for conservatorship to force her to go. It is not a pleasant situation, but would be neglect to allow her tp injure herself while alone. Contact me in you need to do conservatorship.
