Legal Question in Family Law in California

my 20 year old daughter is married. her husband got out of the military and went with the baby ( turned 1 in august) to michigan to live with his mother to help get on his feet until my daughter living with a friend, could finish her medical assistant school. Her husband was suppose to return with the baby to california after she graduated. My daughter had to pawn some of her stuff to pay expenses, she was not getting any supprt. then, all there stuff in storage her husband stopped payment and is now going to auction. Now her husband refuses to come back to california, has moved out of his mothers house with the baby into a friends house in kentucky. He is unable to support the baby on his own and is refusing at times to let my daighter see the baby on the computer until she pays for his phone. Prior to that he wanted my daughter to pay for his flight, accomodations to california. hat would be the only way she could see her daughter fo the graduation in november. Now he says that he can not fly out at all. My daughter graduates from school in november and does not drive or work at this time.

She needs to file a dissolution or other child custody action. If she waits too long California will lose jurisdiction over the case and then your daughter will be traveling to another state to establish custody rights. Good Luck, Pat McCrary
