how do you get an annulment in califonia if the marriage was not legal because the man was still married but thought he was divorced. the marriage is less than 2 years old and there are no property or custudy or child support involve. i just want to make it null and void. and how long would it take?

You would file for an annulment. You use the same form as the petition for dissolution but you just check different boxes to reflect the cause of action and the relief requested. How fast you can get it resolved depends on how fast you can set it for trial. The rule of thumb for divorces is 6 months minimum. It should apply for nullities too. Since grounds for annulment must be proven, you would probably be looking at a litigated case.
