Legal Question in Family Law in California

Family Law

My ex husband has a history of domestic violence, I was awarded a restraining order against him 1/04 I have sole physically custody of our daughter, joint legal, he has visitation every other weekend. In June he took a job out of the country, Iraq with a US company. Before he left there were several incidents of emotional, verbal and mental abuse towards my daughter from him. He said to her that he did not ever want to see her again, he hated her, he was going to find a new family and never see her again. He also picked her up after school with out my knowledge, got angry, and dropped her off down the street from my work and told her to get the f--- out of the car and other angry hurtful things. Also, he left her some boxes with things in them for her, one box containing 2 hand grenades. which after calling the sheriff's/bomb squad turned out not to contain explosives, but was told they could have burned my daughter due to the fusues. His neighbors also told me he spent many weekends drinking with a known convicted child molester that lived across the street from him. I do not know when he will return and am worried that he will pick her up from school without me knowing. Is there something I could do to protect my daughter?

Re: Family Law

You may request supervised visitation and contact the school so as not to allow him to pick her up or take her out of school. You need to file an OSC to schedule a hearing. Contact me directly for assistance.

Re: Family Law

You should file a motion to modify the custody order so that your daughter will be protected if and when he comes back. At the same time you can ask for a modification of the child support. This could get messy, I suggest you retain an attorney. Good Luck, Pat McCrary
