Legal Question in Family Law in California
legal marriage
My divorce was final in Dec. 1996, after 11 years of marriage. But, while drunk I went to Nevada and got married in May 1996, which was promply decided a mistake on both parts, never consummated and have not see each other since.
Is this May marriage legal? I live in CA but if took place in Nevada.

Re: legal marriage
A marriage that is legal in Nevada is legal in California. You do not need residency to get married. From what you have written you are married. Good Luck, Pat McCrary
Re: legal marriage
If you got married in Nevada in May of 1996, some six months before your prior marriage had been legally dissolved, then the Nevada marriage was likely void or voidable ab initio(that means from its inception)under California or the law of any other U.S. jurisdiction.
I just handled a similar situation in Virginia, representing a client who had married(unknown to him at the time) a woman almost a year before her previous marriage had been legally dissolved. This client then filed for and received an annulment of this marriage in the Alexandria City Circuit Court as the marriage was considered void or voidable under Virginia law.
