Legal Question in Civil Litigation in California

What can I do about my missing dog? My dog became missing since 8/11/09. The guy from the gas company open the back gate and my dog went out. I called the gas company what time the meter checker came to my home and they seemed to be reluctant to get back to me. after callling them for 4 times someone contacted me to find out what happened. He then told me that he was going to submit a claim to the company. someone contacted me and told me that they can pay for the cost of my dog. What about the emotional distress My children, wife and me are experiencing? We can not sleep since we do not know what happened to our dog. it is very painful and stressful not having our dog. We have looked for it at Shelter, all around our neighborhood, placed flyers all over and it has not been found. Dealing with the emotional distress is completely hard. What can be done since the claims department says that they can pay for the price of the dog.

Sorry to hear about your loss. Unfortunately in California the only thing you can get is the replacement cost of the animal which is totally inadequate to compensate anyone for the loss of their pet. We're tried unsuccessfully and only until the legislature changes the law. Pet owners will continue to be second class citizens and be denied fair and just compensation for their losses
