Legal Question in Civil Litigation in California

neighbor's pit breaks tunnels into my backyard and kills my caged pet

is there anything I can do about my neighbors pit bull tunneling under the fence into my backyard, breaking into my pet chicken's cage and killing him? any destruction of property law or anything? the dog is aggressive to people too and I fear for my other animal's and children's safety in my own backyard...

Complain to the pound to seize the dog as a danger. Sue the neighbor in small claims court for the damages. Seek a restraining order against the neighbor. If the animal is in your yard threatening you or family, you'd probably be within your rights to kill it, but would run the risk of being accused and arrested for 'animal cruelty'. In our current warped society, animals have more 'rights' than people.
