What is your question? You can pay $40,000, go bankrupt, or get a lawyer and fight it. If you receive a lawsuit and you don't respond in time, you lose by default, see option #1.
Re: Sued by neighbor for making to much noise
In order to avoid a default judgment against you, you must either negotiate a settlement of some kind with her, or litigate and defend the lawsuit. Your sale may provide an argument in your defense and negotiations, but does not negate the issue of her Complaint. These cases can be resolved quickly and cheaply, if both parties are reasonable. You may have coverage under your homeowners' insurance policy, immediately check with them. If you do, turn it over to them. If not, and if you are serious about getting legal counsel to represent you in this, feel free to contact me.

You will still have to answer or respond to the complaint. Please contact me if you have any questions.
