Legal Question in Immigration Law in California

approved 1-130

i recently received an approval on my 1-130, i entered illegaly in to the us when i was 12, now am 26, my question is that, since i connot adjust here because of the law that ended back on april 2000, if i go to Juarez Mexico, and try to adjust there, how long would it take me to come back, or would i be barred from coming back, i have been married for 6 years to an american citizen and we have a 3 year old daughter, i have been living here in the US for the past 14 years.

Hi,

Congrats on the approval. The process of applying at the US Consualte is very different than applying in the US, due to your illegal status you will be subject to the 3-10 year bar and will need a waiver.

The waivers are not easy to get but are possible. In your case it will based on extreme hardship to your spouse and US citizen child.

But before considering going to Mexico, I would check your optiuons in the US here. I would need to know when was the I-130 filed, what was the status of your husband when it was filed, any other petitions filed in the past 14 years. You will be surprised how many old law can be reactivated with some research.

The court option should also be explored, there is possibility of relief for people that lived in the US for 10 years or longer with good moral chracter.
