Legal Question in Employment Law in California

Fired by homosexual assistant manager who i lived / sexual harrassment

I worked for a fast food chain about 3 years ago. I moved to a new location when I was 19 yrs old in CA. I had not place to go so found a roomate at the store I was going to work at. My roomate was the assistant manager for where I worked. The assistant manager was a homosexual and made several passes at me both at work and home. He on several occasions touched me innapropriately. I was afraid to talk to the manager about it because she is his best friend and also homosexual. I was very uncomfortable. I started working a 2nd job and had put in my 2-weeks notice. I had this assistant mgr cover one of my shifts earlier the week. He asked me to cover one of his. I said I could not and he got very angry saying ''he has done this and that for me''. I didnt think much about it, but about a week before my 2weeks were up I was told by him he was firing me. He said a few weeks or month prior I signed a paper that said I would not leave the store during my 30-min lunch break. He said if I didnt sign the termination letter I would not receive my final paycheck. Now everytime I want to apply for a job I am afraid this will affect my hirability and feel I was inappropriatley terminated. What can I do? Is there a time limitation?

Were you fired 3 years ago? The statute of limitations on claims of this kind vary, from 1 to 2 years. If this happened under 2 years ago, please contact me at either [email protected] or at my office number listed. If I am not available ask for Joan Cooper, she will speak to you as well. I am terribly sorry for your situation and hope you are doing better now.

Sincerely, Beth

Of course there is a time limitation. If this occurred 3 years ago as implied, you are long past the one year statute for discrimination claims, and the two year statute for employment termination claims. However, if it occurred less than two years ago, and you have any evidence or witnesses to corroborate what you claim, then feel free to contact me to discuss the facts and potential case.
