Legal Question in Employment Law in California

I was terminated from my job this past friday for what I deem dishonesty although I was not yet advised. I was a Regional Rep visiting clients all over CA and was given a $25 food allowance per day. My preference, at times, was to use this money to buy groceries to make food at home. The Travel & Expense Guidelines in this company are vague and ambiguous. Also, I just got married a couple of weeks back and have a baby girl due Nov 14th. The company has more or less told me that I will not be able to collect unemployment and my health insurance runs out at the end of October. Can they legally cut off insurance for an expecting family with one income which has now been completely cut off?

You might speak with an attorney about whether the termination was a pretext because you're about to have a child. That might be wrongful termination based upon discrimination.

Firing for misconduct could mean denial of unemployment benefits. You can appeal that EDD decision, and may have adequate grounds to show it was not really misconduct. You won't know unless you try. Misconduct could also result in denial of COBRA conversion of insurance benefits. You and your attorney may be able to negotiate and persuade the company to not categorize it as misconduct. That would save you the risk and cost of appealing. If serious about hiring counsel to help you in this, feel free to contact me.
