Legal Question in Employment Law in California

Wrongful fire Versis Unemployement Bene

My husband was fired from his job, last month. Was told to leave, was giving his check. He filed for Unemployment, the company contested it, they said he left the company. Now they are saying he was fired, but this is the reason he was fired. He was never written up for anything. At the hearing all these different emails popped up; trying to be used against him. The company had a lawyer should we get a lawyer? My husband was being used at this company. Time and time again I told him that, he worked long hours, other peoples schedule at the drop of a hat. Never took vacation or time off with his family, missed his son birthday. Was told he would be getting a raise doing a good job, then two weeks later he gets fired.

This sounds like a horrible situation where the employer has built up evidence against your husband. I suggest he starts to immediately document via a timeline of events and collect any documents he has from his employment and then contact an attorney.

Based on your question/comments, I am not certain what claims exist at this time. However, it is possible that there is a wage claim and a wrongful termination claim. Nevertheless, I (and any attorney for that matter) would need to know far more information.

Please feel free to contact my office or an attorney in your area.

Best of luck,

Beth Mora
